Americans with Disabilities Act considerations for the practice of occupational medicine

The Americans with Disabilities Act (ADA), although developed in the context of civil rights legislation, is likely to have notable impact on the practice of occupational medicine. The ADA contains provisions limiting the use of preplacement examinations to determinations of the capability to perform the essential functions of the job and of direct threat to the health and safety of the job applicant and others. The Title 1 employment provisions of the ADA established definitions and requirements similar to those found in section 504 of the Rehabilitation Act of 1973, as amended; leading cases that have been litigated under the Rehabilitation Act, as amended, are described. The limitations of available scientific and medical information related to determinations of job capability and direct threat and ramifications of the ADA on the practice of occupational medicine are discussed.

How Time Inefficient and Uncertain are Paratransit Trips Compared to Car Trips

The Americans with Disabilities Act (ADA) stipulates that paratransit mobility be comparable to public transit. However, with just under 5% of the population relying on public transportation, transit is not a representative benchmark. To highlight this inequality, we compare trip times by paratransit to counterfactual car-based travel. Using 2.5 years of demand data from the Denver Regional Transportation District's Access-a-Ride service, we compare paratransit trip times to counterfactual car-based trips for the same origin-destination pairs, controlling for various trip characteristics. Compared to car travel, the findings indicate high variability and uncertainty associated with paratransit trip times. For the same origin-destination pairs, the mean paratransit trip time is almost twice that of the mean car travel time, with a standard deviation for paratransit trip time fourfold that of the standard deviation for car trip time. For perspective, traveling an average of 10 mi during the 7-8 a.m. morning peak can take about 16 min by car with almost no variability, while that same trip can take an average of 25 min by paratransit, with 5% of trips being outside the 95% confidence interval and thus unpredictable. Paratransit trip time inefficiency tends to be particularly worse for females; older adults; those making trips between 9 and 11 a.m.; cash-paying customers; those making shorter trips; and those traveling during inclement weather, including cold temperatures. These findings suggest a need to re-assess using public transit as a benchmark for paratransit supply as regulated by the ADA.

Passenger Boarding Station and Curbfront Configuration Concepts for On-Demand Services with Small Automated Vehicles

This paper explores the various configurations of off-line stations and vehicle berthing that have been found to be fundamentally important parameters in the analysis of system performance, operations, and capacity. The proposed automated transit network system concept, which provides a direct ride between a passenger's origin and destination station, is applicable to both fixed guideway automated transit and to systems with self-driving vehicles. Addressed at a conceptual level is the vehicle/station interface in terms of Americans with Disability Act compliance and station capacity concerns. The concept of open-edge platforms monitored by advanced sensing technology combined with artificial intelligence-powered perception for the purpose of protecting passengers from entering the active vehicle lanes is also discussed. Finally, the paper draws initial conclusions on how these station configurations, operational complexities, and associated costs can be better understood through appropriate research and development.

Georgia Committee on Employment of People with Disabilities

Young people with disabilities have more opportunities and more challenges than at any other time in our nation's history. With the Americans with Disabilities Act, they have unprecedented opportunities to fully develop as constructive, contributing members of our society. However, many need encouragement to develop as leaders in their communities. Our forum enables them to learn from each other and from successful adults with disabilities who are recognized leaders and role models. Such a forum benefits not only the participants, but all young people with disabilities, our communities in general, and the adults who assist in producing the forum.
